These Terms & Conditions ("Terms") govern your access to and use of www.thedutchcontractor.com and any related pages, forms, or content (the "Site"). The Site is operated by Bellamy Building Contracting L.L.C. ("Bellamy", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms.

Important: These Terms cover use of the Site and how we handle enquiries made through it. If you engage Bellamy for construction, fit‑out or renovation works, your project will be governed by a separate written services agreement/BOQ, which will prevail in case of inconsistency.

2. Eligibility & Local Market

The Site is intended for users located in the United Arab Emirates. If you access the Site from another jurisdiction, you are responsible for compliance with applicable local laws. Any reference to pricing, availability, or services is specific to the UAE unless stated otherwise.

3. Use of the Site

You agree to use the Site lawfully and not to:

Interfere with the security or proper functioning of the Site;

Upload or transmit malware, spam, or unlawful content;

Scrape, copy, or reproduce content except as permitted under section 10 (Intellectual Property).
We may suspend or terminate access if we reasonably believe your use breaches these Terms.

4. Enquiries, Consultations & Estimates via the Site

4.1 Enquiry forms. By submitting a form, you confirm the information provided is accurate and that we may contact you by phone, email, SMS or WhatsApp about your enquiry.

4.2 Initial consultations. Any discovery call or site visit scheduled via the Site is indicative and subject to confirmation and availability.

4.3 Non‑binding estimates. Any estimate generated from an online form or shared following an initial consultation is indicative only and not a binding offer. Final scope, price, programme, deliverables and payment schedule will be set out in a signed services agreement and/or Bill of Quantities (BOQ) and change orders.

5. Services, Scope & Change Orders (Overview)

5.1 Services. Bellamy provides villa renovation, fit‑out and design‑build services. Specific services for your project will be defined in the services agreement/BOQ.

5.2 Variations. Changes requested by you or required due to site conditions, authority requirements, or design development will be treated as variations through written change orders with associated adjustments to price and programme.

5.3 Subcontractors & suppliers. We may engage vetted subcontractors and suppliers. We remain responsible for overall coordination under your services agreement.

6. Pricing, Payments & Taxes (Overview)

6.1 Milestone billing. Unless otherwise agreed, invoicing follows milestone or monthly progress billing as defined in the services agreement/BOQ.

6.2 Deposits & mobilisation. Mobilisation may require an advance payment, performance guarantees, or insurance as stipulated in your services agreement.

6.3 Taxes. Prices are exclusive of VAT unless stated. Where applicable, VAT will be charged at the prevailing rate.

7. Permits, Approvals & Access (Overview)

7.1 Authorities & community approvals. You authorise us (or your consultant) to liaise with relevant authorities and communities to obtain required permits/approvals. Fees and lead times will be as per the services agreement.

7.2 Site access. You will provide timely access to the site, utilities and lifts and ensure the site is free of occupants unless otherwise agreed.

8. Warranties & Defects (Overview)

8.1 Workmanship warranty. We provide workmanship and material warranties as specified in the services agreement. A defects liability period will be defined therein.

8.2 Exclusions. Normal wear and tear, misuse, lack of maintenance, or third‑party interference are excluded unless required by law.

9. Reviews & Testimonials

If you submit a review, you grant us a non‑exclusive right to display, reproduce and share it on the Site and our social channels, provided we do not edit it in a misleading way. We may request proof that a review is genuine.

10. Intellectual Property

The Site and its content (text, images, graphics, logos, layouts, videos and documents) are owned by Bellamy or our licensors and are protected by UAE and international IP laws. You may view, download, and print content for personal, non‑commercial use. Any other use requires our prior written consent.

11. Project Photography & Portfolio

Unless you object in writing before practical completion, you grant us permission to photograph completed works and to use non‑identifying images and general project descriptions in our portfolio and marketing. We will not disclose your address or personal data without consent.

12. Privacy & Data Protection

12.1 Personal data. When you use the Site or submit forms, we collect limited personal data (e.g., name, contact details, project location). We process this to respond to enquiries, deliver services and improve the Site.

12.2 Legal basis & rights. We follow applicable UAE data‑protection requirements. You may have rights to access, correct, delete, or object to processing of your personal data, subject to legal limitations. A separate Privacy Notice describing our data practices in detail forms part of these Terms.

12.4 Marketing communications. We obtain consent before sending direct electronic marketing and provide clear unsubscribe mechanisms. You may withdraw consent at any time.

To the extent permitted by law, the Site and its content are provided "as is" and "as available" for general information only. Nothing on the Site constitutes professional advice. Project outcomes depend on site conditions, authority requirements and design choices.

15. Limitation of Liability

To the maximum extent permitted by law, Bellamy is not liable for any indirect, incidental, special or consequential losses arising from your use of the Site. For paid services, liability will be governed by your services agreement.

16. Indemnity

You agree to indemnify Bellamy against claims arising from your misuse of the Site or breach of these Terms.

17. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, authority delays, labour disputes, supply chain disruptions or utility failures.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The Dubai Courts shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.

19. Consumer Information

Nothing in these Terms limits your statutory rights under applicable UAE consumer protection laws.

20. Changes to the Site or These Terms

We may update the Site and these Terms from time to time. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance.
